Marshall's description of the reason for Blackbear's victory does not help "Dumb Starbucks," which is doing business or parody business under an infringing name.

Maybe "Dumb Starbucks" would have a better chance if they claim that Starbucks itself is doing a parody of actual coffee

I'd bet Starbucks backs off now. If they attempt to beat up on Comedy Central they'll just come off as bad sports who can't take a joke.
